What Are Punitive Damages?
Punitive damages are a court-ordered monetary award intended to punish a defendant whose conduct was egregious, malicious, wanton or grossly negligent. They are awarded to a plaintiff in addition to compensatory damages, which are designed to compensate the injured party for their losses (e.g., medical expenses).
Punitive damages may also be called “exemplary damages” because the award can serve as an example of a potential consequence of this conduct. With the knowledge of this example, the defendant or other parties may be deterred from acting similarly.
